The following terms and conditions ("Email Terms and Conditions") are supplemental to the General Conditions and shall apply in the contract. We operate email services ("Email Service") for the transmission, receipt and storage of Electronic Messages ("Email").
- Definitions
- 1.1. The definitions and rules of interpretation in this condition apply in the Conditions:
"Spam" refers to Emails sent to multiple recipients who have not agreed to receive the Email, including but not limited to Unsolicited Commercial Email and Unsolicited Bulk Email.
"User" refers to the person, persons, or entity using a specific Email account (designated by a unique email address).
- 1.1. The definitions and rules of interpretation in this condition apply in the Conditions:
- General
- 2.1. Without exception, We do not allow the use of Our Email Service for sending mass Email of any type to recipient's that haven't requested the Email.
- 2.2. We expressly prohibit the use of Our systems in any manner associated with the transmission, distribution or delivery of Spam.
- 2.3. Any User of Our Email Service who sends Spam may have their account disabled and Email Service revoked without archive or notification in order to protect all users of Our Email Service.
- 2.4. Spam sent from other networks which references Email hosted on Our Email Service shall be treated as if it originated from the account referenced.
- Filtering of Email
- 3.1. Without prejudice to Our other rights and remedies, We reserve the right to filter Email using commonly accepted standards to protect the provision of our Email Service to all Users. This is necessary to ensure Our Email Service remains available for all Users to send and receive Email to all destinations on the Internet.
- Mass Mailing
- 4.1. We do not support outbound mass Email sending. We limit the number of Emails You can send using a number of technical algorithms to prevent abuse. We do not publish these algorithms and will not disclose detailed information about them for the security of all Users of Our Email Service. If You reach this limit You will receive an error message.
- Liability
- 5.1. We will not be liable to You in contract, tort or otherwise, including negligence for any direct or indirect immediate or consequential loss, damage, costs, expenses or other claims arising out of or in connection with;
- 5.1.1. any Email sent to You that may contain a Virus or have been sent as Spam;
- 5.1.2. use of Our Email Service on a Domain Name System and/or Name Servers not provided by Us.
- 5.1. We will not be liable to You in contract, tort or otherwise, including negligence for any direct or indirect immediate or consequential loss, damage, costs, expenses or other claims arising out of or in connection with;
